Limited Warranty Terms and Conditions

Subject to the provisions described below, this product is protected by a limited warranty on parts and labor for any defects and workmanship as follows:

90-Day Coverage for EVEBRA Components

All components of the EVEBRA are covered for 90 days. Should this product fail to perform as described in the Instruction For Use booklet within the warranty time specified above, LIPOCOSM, LLC, will ship a replacement part for the failed part(s) via 2-day express mail. The defective part MUST be returned to LIPOCOSM, LLC using the original packaging, or packaged by you with care to avoid additional damage, within 7 days after receiving the replacement to avoid billing for the defective part replacement.

Repair or Replacement

Products that fail within the warranty period, following receipt of the EVEBRA, will be repaired or replaced with the same or functionally equivalent product by LIPOCOSM, LLC, at its discretion, free of charge provided you return the failed product to LIPOCOSM, LLC designated repair facility with shipping prepaid and provide LIPOCSOM, LLC with the original date that the product was ordered and the date you began use. Repaired or replacement products will be returned to you with the shipping prepaid. Replacement product may be refurbished or contain refurbished materials.

Refund Policy

If LIPOCOSM, LLC by its sole determination is unable to repair or replace defective product, it will refund the purchase price of the EVEBRA components only.

Exclusions and Limitations

This warranty does not apply if, in the judgment of LIPOCSOM, LLC, the product fails due to damage from storage, accident, abuse, or misuse, or if it has been used or maintained in a manner not conforming to the product manual instructions, has been modified in any way, or has had any serial number removed or defaced. Repair by anyone other than LIPOCOSM, LLC, or an approved EVEBRA repair facility, will void this warranty. The maximum liability of LIPOCSOM, LLC, under this warranty is limited to the purchase price of the components of the product covered by the warranty.

Return Procedures

Prior to returning any defective product, the end customer or authorized reseller from whom the end customer originally purchased the product must obtain a Return Materials Authorization (RMA) number from LIPOCOSM, LLC, by calling Customer Care 1-786-741-8156. All defective products should be returned to LIPOCOSM, LLC with shipping charges prepaid. LIPOCOSM, LLC will not accept collect shipments.

EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT OR AS REQUIRED BY LAW THE WARRANTIES AND REMEDIES STATED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL, OR WRITTEN, EXPRESSED OR IMPLIED. ANY AND ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS ARE EXPRESSLY EXCLUDED. LIPOCOSM, LLC SHALL NOT UNDER ANY CIRCUMSTANCE BE LIABLE TO ANY PERSON FOR ANY SPECIAL, INCIDENTIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES RESULTING FROM USE OR MALFUNCTION OF THE PRODUCT, LOSS OF PROFITS OR REVENUES OR COSTS OF REPLACEMENT GOODS, EVEN IF LIPOCOSM, LLC, IS INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
